What are the recycling rules for retailers?
Retailers in England must separate dry recycling, food waste and general waste under Simpler Recycling and follow a legal duty of care for all the waste they produce.
The rules have applied to businesses with 10 or more full-time-equivalent employees since 31 March 2025. Businesses with fewer than 10 full-time-equivalent employees must comply by 31 March 2027, the same date plastic film must be added to recycling collections.
If you run more than one store, the employee count covers your whole business, not each branch. A chain of small shops with 10 or more staff in total has had to comply since March 2025.
Your duty of care means storing waste securely, describing it accurately and passing it only to an authorised waste carrier.
Every collection comes with a waste transfer note, giving you a clear record of where your waste went. You must keep these for at least two years. They’re also ready to show landlords, auditors and head office whenever they ask.
